Position Summary

This position provides integral support to the litigation team, within the Risk Management department, with respect to a variety litigation matters. As part of the job, the employee will be expected to assist with all stages of litigation matters to include commencement of actions, discovery, pre-trial preparation, and trial/arbitration. Performs additional general duties to include drafting motions, correspondence, and maintaining/preserving legal opinions/material database.

  • Commencement of Action - Conduct a full fact investigation and analysis of the complaint. The investigation may include visiting the incident/accident scene, background investigations of witnesses, the gathering of affidavit(s), written statements and photographs, and the gathering of other physical evidence from third parties
  • Responsible for analyzing of documents and the preparation of medical chronologies, drafting of pleadings, motions and memorandums
  • Formulates a discovery plan with in-house attorney(s)
    • Drafting discovery requests such as requests for production, interrogatories, requests for copies, and requests for admissions
  • Prepare nonparty discovery requests such as subpoenas duces tecum with/without deposition, public records requests, authorizations and release of records and conduct Internet public records research
  • Prepare motions, such as to compel discovery and motions to dismiss. Conduct legal research in support of the motions they draft
  • Prepare witnesses for deposition
    • Attend depositions with attorneys, take notes and summarize testimony
    • Prepare notebooks including, but not limited to, medical chronologies, discovery responses, photographs and other relevant documents/information for the deposition
  • Responsible for scheduling surveillance
  • Prepare trial/arbitration and mediation notebooks which may include witness data, exhibits and legal authority
    • Set up and organize visual and demonstrative aides for trial/arbitration and mediations as well. Additional pretrial preparation may include preparing summaries, designations, questions, instructions, forms and other documentation and/or support as required
  • Draft and arrange for the service of subpoenas for trial/arbitration
    • Schedule and prepare witnesses for testimony
    • Attend trial/arbitration and takes notes in preparation for future strategy discussion and for reporting purposes to insurance company (Club)
  • Draft motions and stipulations, (i.e., dismissal, extensions of time)
  • Conduct legal research, including shepardizing and cite check
  • Draft correspondence to witnesses, experts, and others
  • Maintain or assist with the preservation of legal opinions/material database.

Requirements

  • Minimum five years of paralegal experience in a corporate in-house department or large law firm
  • Excellent skills working directly with internal clients, outside counsel, state regulatory and licensing agencies
  • Excellent verbal and written communication skills
  • Flexible and able to set priorities, handle multiple projects, manage deadlines and work effectively with people
  • Detail-oriented and very organized
  • Strong research and interpersonal skills
  • Experienced with preparation of discovery responses and objections
  • Experienced with summarization of medical and other types of records
  • Ability to assist with large document production
  • Ability to utilize Adobe for electronic production issues and other such litigation paralegal tasks
  • Experience and knowledge of the Federal Court CM/ECF system and filings.

Preferred:

Associates degree in legal/business areas preferred and paralegal training and/or degree.
